Because of this, it is tempting to hire the first injury attorney you see an advertisement for. However, when you are picking an attorney to work with, putting a little effort into the selection process will pay off. When you are searching for an injury attorney, here’s what you should look for:

  1. Knowledge – An attorney that specializes in tax law or estate planning won’t do you much good if you were injured in an accident. Make sure that the attorney you are hiring is knowledgeable about what your case will entail and has worked on similar cases in the past.
  2. Support – The days following an accident can be emotionally taxing. The injury attorney you hire should be a source of strength and support, and he or she should give you confidence in the outcome of your case.
  3. Experience – Although handing over your case to your friend who is fresh out of law school may seem like the nice thing to do, working with an injury attorney without much experience could harm you in the end. Find out what your lawyer’s history is like working on injury cases that are similar to yours.
  4. Urgency – Oftentimes, injury attorneys will take on too many cases at once and promise their clients quick results. Find a lawyer who won’t delay in starting the legal process and makes your case their first priority.

Looking for these four qualities in an attorney will ensure that your case goes smoothly and that you are satisfied with the outcome.

What Damages Are Compensated in a Wrongful Death Case? http://www.jasonetaylor.com/blog/what-damages-are-compensated-in-a-wrongful-death-case/ http://www.jasonetaylor.com/blog/what-damages-are-compensated-in-a-wrongful-death-case/#comments Tue, 01 Apr 2014 00:22:58 +0000 Administrator http://www.jasonetaylor.com/?p=1526 If one of your family members was killed because of the negligence of someone else, you may be feeling hurt, confused, and nervous about your future. In order to minimize the impact the death of your loved one has on you and your family, you may be eligible for wrongful death compensation.

This type of compensation is usually divided into two categories: economic damages and non-economic damages. Economic damages include the financial contributions the deceased person would have made to their family members if they did not die. Compensation for economic damages usually covers medical and funeral expenses, the victim’s expected earnings, and the value of any goods or services the deceased individual would have provided over the course of the rest of his or her lifetime.

Wrongful death compensation for non-economic damages is designed to cover expenses that are less tangible in nature. Non-economic damages may cover payment for the family members’ pain and suffering, the loss of care and protection from the deceased, and the loss of love from the individual who passed away.

Calculating the total of what wrongful death damages should amount to can be extremely complicated. Often, economists and actuaries are used to calculate the amount of compensation that should be given to the deceased’s family members. In addition to these experts, it is also beneficial to have an attorney to help the relatives of the deceased victims receive fair compensation. If one of your loved ones was wrongfully killed, contact an attorney who can fight for you and your family members’ rights to full and fair wrongful death compensation.

7 Signs That You May Be the Victim of Medical Malpractice http://www.jasonetaylor.com/blog/7-signs-that-you-may-be-the-victim-of-medical-malpractice/ http://www.jasonetaylor.com/blog/7-signs-that-you-may-be-the-victim-of-medical-malpractice/#comments Tue, 04 Mar 2014 00:34:25 +0000 Administrator http://www.jasonetaylor.com/?p=1310 Going in for a routine medical procedure only to find that surgical items were left behind in your body or a doctor misdiagnosed you with a certain illness can be frightening. Unfortunately, instances of medical malpractice likes these are all too common and have severe consequences. If you are unsure whether or not you received inadequate medical care, here are a few signs that may indicate you are the victim of medical malpractice:

  1. The treatment you have been receiving is ineffective or seems to be making your condition worse.
  2. Only one test was ordered by your doctor to determine whether you had an illness or condition.
  3. A standard procedure usually used to diagnose a disease was completely skipped.
  4. You have questions about the status of your care, but your doctor fails to provide you with information or avoids your inquiries altogether.
  5. Your doctor fails to provide you with a diagnosis, or it seems delayed.
  6. You had to undergo additional surgeries or treatments to fix the results of a previous surgery or treatment.
  7. Your doctor is unresponsive, and any medical professionals you are receiving care from fail to follow up with you after procedures.

Although there are many signs that you may have been the victim of medical malpractice, these are just a few of the most common. If you believe you have received inadequate medical care, it is important that you contact an attorney who specializes in medical malpractice to determine whether you have a case against your health care provider.

5 Steps Every Driver Should Follow After Car Accidents http://www.jasonetaylor.com/blog/5-steps-every-driver-should-follow-after-car-accidents/ http://www.jasonetaylor.com/blog/5-steps-every-driver-should-follow-after-car-accidents/#comments Mon, 03 Feb 2014 15:00:12 +0000 Administrator http://www.jasonetaylor.com/?p=1290 Car accidents can be unexpected and stressful. You may have incurred injuries and have to go without a working vehicle for a while. On top of all this, the other driver may not admit that they were at fault for the accident. Although car accidents can be difficult to get through, following these steps will ensure that the days following the accident go smoothly:

  1. Immediately following the accident, take a deep breath and try and stay calm.
  2. Check to see if anyone is injured, and call an ambulance if there is a need.
  3. Get in contact with the police and your insurance provider as soon as possible.
  4. Obtain as much information about the accident as you can, and get contact information from other drivers, passengers, and witnesses.
  5. Don’t talk about the accident with anyone but the authorities and your insurance agent.

Many drivers who are involved in car accidents fail to follow these steps and regret not being more involved in this process after the accident occurred.

In addition to taking these steps, hiring a car accident attorney should also be a high priority on your list. Lawyers who specialize in car accidents will help you obtain proper compensation for your injuries and establish a sturdy case against the other driver in court if the need arises. Your attorney will also be able to advise you about what steps you should take next following the accident so you are able to get back to your normal daily life as soon as possible.

Disability Claims – SSDI vs. SSI http://www.jasonetaylor.com/blog/disability-claims-ssdi-vs-ssi/ http://www.jasonetaylor.com/blog/disability-claims-ssdi-vs-ssi/#comments Tue, 07 Jan 2014 00:06:17 +0000 Administrator http://www.jasonetaylor.com/?p=1223 Disability claims can differ depending on a variety of factors, and claims are generally placed in one of two categories: Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI). Both are government programs and have in common that they provide means to living for people who find themselves in difficult situations, but there are many differences between the two, as well.

Under SSDI, the disabled person is required to have paid some sort of Social Security taxes in order to be eligible for benefits. Paying these taxes is regarded as a sort of insurance plan in itself, and the amount for which the disabled person is eligible is determined by the monthly amount he or she has paid in taxes. There is also a five-month waiting period after disability claims are filed before any money is distributed by the program.

A person enrolled in the SSDI program must be less than 65 years of age, and in order to receive benefits he or she must have accumulated a certain number of work hours; this number can vary depending on a variety of factors. Additionally, family members who are dependent on the person having made the disability claim are eligible for “auxiliary benefits”. After two years of receiving SSDI benefits, the disabled person becomes eligible for Medicare.

SSI, on the other hand, is not based on previous work-hour history or any amount paid into the system. Instead, it is funded by the general taxpayer and is distributed based on financial need, determined by the assets and monthly income of the recipient. Those qualifying for SSI benefits also become eligible for Medicaid, and SSI benefits start on the first of the month during which the claim was filed.

For help with disability claims, whether SSDI or SSI, contact a rights attorney. He or she can ensure the claim is filed correctly and punctually, providing much-needed peace of mind. Additionally, an attorney can help in difficult situations where disability claims may have been unfairly rejected.

A Workers’ Compensation Attorney Can Help in Case of a Work Injury http://www.jasonetaylor.com/blog/a-workers-compensation-attorney-can-help-in-case-of-a-work-injury/ http://www.jasonetaylor.com/blog/a-workers-compensation-attorney-can-help-in-case-of-a-work-injury/#comments Tue, 10 Dec 2013 00:11:45 +0000 Administrator http://www.jasonetaylor.com/?p=1155 Contacting a workers’ compensation attorney in case of a work injury is the first step to collecting the benefits to which you may be entitled under the North Carolina Workers’ Compensation Act of 1929. Under this act, a company employing three or more workers must provide some sort of benefits to workers who are injured while on the job. A workers’ compensation attorney can help you through the steps necessary to ensuring you receive the compensation you deserve.

Contacting a workers’ compensation attorney immediately after you suffer an injury is essential to any case involving an on-the-job injury. Certain critical steps must be taken, or else the injured worker risks possibly surrendering rights to compensation.

While receiving medical attention for the injury, it is also important that the injured worker tell the medical physician the injury was incurred by accident while working.

After visiting the workers’ compensation-approved doctor, it is critical that the injured follows the doctor’s instructions carefully. The goal is to restore health as nearly as possible to the condition it was before the workplace accident occurred. Any deviation from the advised medical plan may complicate the receiving of benefits through a workers’ compensation plan.

If you have suffered a workplace injury, contact a workers’ compensation attorney immediately. Making sure you handle the situation appropriately will ensure you receive the proper compensation you need to restore yourself to your former health as quickly as possible.

5 Common Motorcycle Accident Causes http://www.jasonetaylor.com/blog/5-common-motorcycle-accident-causes/ http://www.jasonetaylor.com/blog/5-common-motorcycle-accident-causes/#comments Tue, 12 Nov 2013 00:28:12 +0000 Administrator http://www.jasonetaylor.com/?p=1147 A motorcycle accident is often potentially more dangerous and destructive than similar accidents involving conventional automobiles, if only for the reason that a motorcycle driver is more exposed. What can be simply a case of a moderate fender-bender in the case of two cars can be tragic if a motorcycle is involved. Here are five common occurrences that may contribute to a motorcycle accident.

  1. Cars Turning Left – According to some statistics, cars making a left-hand turn are one of the most common causes of motorcycle accidents. These accidents tend to occur as the motorcycle is passing through a busy intersection or passing a car. Though the car making the left hand turn during the accident is usually found to be at fault, other factors may shift blame toward (and compensation away from) the motorcyclist (for example, speeding or passing illegally).
  2. Lane Splitting – Lane splitting is using the space between cars in adjacent lanes to pass. This usually happens at a light or in a traffic jam. When a motorcycle accident occurs during lane splitting, whether the motorcyclist or the automobile driver is to blame can vary depending on state and local laws.
  3. Roadway Hazards – Motorcyclists are much more at risk to roadway hazards than are drivers in cars. Factors such as road construction, wet pavement and loose gravel can cause a motorcyclist to lose control more easily than the driver of a car. Additionally, motorcyclists are offered much less protection by the bike during a crash than are motorists by their cars.
  4. Irresponsible Driving – Speeding and the use of alcohol are unsafe and illegal driving practices for anyone operating a motor vehicle, but the risk is even higher for a motorcyclist. Operating a motorcycle takes much more control and attention than does a car, and dulled senses and reflexes can be far more costly.
  5. Sudden Stopping – While a quick and unexpected stop leading to a rear-end collision between two cars usually does not end in tragedy, such a motorcycle accident can result in serious damage and injury. A motorcyclist is not offered the protective barrier that a motorist in a car is, and a driver behind a motorcycle may be just a bit less likely to notice the motorcyclist has stopped.

How a Medical Attorney Can Help You Prove Doctor Liability in a Malpractice Case http://www.jasonetaylor.com/blog/how-a-medical-attorney-can-help-you-prove-doctor-liability-in-a-malpractice-case/ http://www.jasonetaylor.com/blog/how-a-medical-attorney-can-help-you-prove-doctor-liability-in-a-malpractice-case/#comments Tue, 15 Oct 2013 00:11:04 +0000 Administrator http://www.jasonetaylor.com/?p=1112 Medical malpractice cases are some of the most difficult cases to be undertaken by an attorney and/or plaintiff. These cases involve specific knowledge of proceedings that take years of study and experience to acquire, and even then the details on a case-by-case basis vary dramatically. A medical attorney is an indispensable asset to have in any situation where a party has suffered from medical malpractice.

Medical malpractice falls under the civil suit category. A civil suit can be made when one private party feels another has been directly responsible for damages incurred.

In cases involving medical malpractice, it is up to the medical attorney to prove negligence on the part of the accused party. The term “negligence” is actually quite specific, with certain parameters that must be met.

First, negligence must be proven; the accused party must be shown to have breached some duty that is ordinarily expected of him or her. The standards in any field are set by comparison to common practice by peers within the same field. It is the job of the medical attorney to identify what exactly this failed duty is and subsequently prove that the accused breached that duty. This process, however, can be a difficult task requiring a great amount of experience on the part of the attorney.

Next, the medical attorney must prove that some sort of injury or damage was incurred directly due to this breach of duty. Again, this task is often challenging, as an injury may have occurred after the duty was breached, yet the injury may not have been caused directly by this negligence.

Finally, the precise damages caused by the now proven negligence must be assessed. Even simply determining exactly what harm has been done and putting a price on that harm is complex work. In cases involving medical malpractice, a medical attorney is all but a requirement.

Wrongful Death Cases Call for a Qualified Accident Attorney http://www.jasonetaylor.com/blog/wrongful-death-cases-call-for-a-qualified-accident-attorney/ http://www.jasonetaylor.com/blog/wrongful-death-cases-call-for-a-qualified-accident-attorney/#comments Mon, 16 Sep 2013 23:17:46 +0000 Administrator http://www.jasonetaylor.com/?p=1056 It is always a tragedy when an accident occurs that takes the life of a person, regardless of the circumstances. However, when such a disaster takes place and is found to be directly attributable to the negligence of another person or persons, the loss of life may then fall under the category of a wrongful death. Wrongful death cases are handled in civil court rather than criminal court, and the management of the plaintiff’s case by an experienced accident attorney will be all but necessary throughout the process.

Wrongful death scenarios are handled with civil suits rather than criminal; this means no actual law has been broken, but blame may still lie on some involved party. Because no crime has been committed, and because the deceased may not file charges, the responsibility of proceeding through a civil lawsuit usually falls upon close relatives of the deceased. Usually, the close relatives are also the people most affected by the loss of life, both emotionally and financially.

Whoever does take the charge of claiming whatever possible compensation for the wrongful death will be responsible for hiring an accident attorney to help with the case. An accident attorney will have the expertise and experience necessary to give you the best chance of winning recompense for any loss of income, costs of medical care, funeral services, and other damages incurred. He or she will help you meet deadlines for filing required paperwork, decide what evidence is important to the process, and ask the important questions that need to be answered. Never attempt to navigate the courtroom without the guidance of an accident attorney.

  3. Get a Bike with Anti-Lock Brakes – Pay a little more if you must for this life-saving safety feature.
  4. Suit Up With the Proper Attire – Leather is king, but be sure to also have proper eyewear and breathable fabrics covering your entire body.

  7. Enroll in a Motorcycle Safety Course – Education saves lives. Take a course to learn what you need to know to stay safe on the roads.
